-> Sur le non-retour en mains suisses des biens de Interhandel et le non-respect qu'y voit la Suisse de l'Accord de Washington:

"The fact that the considerable assets of the Société Internationale pour Participations Industrielles et Commerciales S.A., hereafter called "Interhandel", which were vested in 1942 and 1943, have to this date not be returned  to their rightful owners, is a cause of great concern to the Gouvernement of Switzerland. Indeesd, all attempts  of the Swiss owners to obtain the return of their property  have so far remained unsuccessfull. As of the present, in view of the latest American court decisions in this matter, which have been restricted to mere procedural grounds, the prospects for a satisfactory overall solution seem to be remote.

The Federal Council is of the opinion that the refusal of the United States Government to return these assets is contrary to Article IV, praragraph 1, of the Swiss-Allied Accord of May 25, 1946. The Federal Council, in principle, as well as on account of the important interests involved, finds it impossible to acquiesce in such a situation.Therefore, it is now confronted with the necessity of giving the matter of ist consideration, not only on the basis of the principles of international law pertaining to the protection of the legitimate interests of a neutral State, which prnciples are recognized both by the United States and Switzerland, but also because the matter involves adherence to an agreement conclued between the Governments of the two countries." (p. 1)

-> Proposition suisse de concilliation internationale:

"Since, over a long period of time, differences of opinion have existed between the Governments of Switzerland and the United States with respect to the interpretation of the aforementioned Accord, which have been the subject of discussions on more than one occasion, the Swiss Government now finds itself compelled to submit the matter to settlement by international proceedings.

In view of the close and friendly relations between Switzerland and the United States, as well as in view of the general principles involved, the Swiss Government regrets that ist repeated suggestions, made especially in the memorandum of the Swiss Legation in Washington, dated December 1, 1954, and ist note of March 1, 1955, concerning the possibility of amicably settling the Interhandel matter in further diplomatic discussions, remained  without positive reaction on the part of the United States Government, so that no other way remains open for the preservation of the interests in question. The Treaty of Arbitration and  Conciliation conclued between Switzerland and the United States on Febraray 16, 1931, provides in Article I that every dispute arising between the contracting parties shall, when ordinary diplomatic proceedings have failed, be submitted "to arbitration or to conciliation", as the contracting parties may at the time decide. An arbitration clause is also contained in the Accord of May 25, 1946. The Federal Council proposes that all necessary arrangements be made in accordance with the applicable provisions of the Treaty of February 16, 1931, but, in making this proposal, it is not intended to waive any rights under the Accord of May 25, 1946." -> Sur la demande suisse de maintenir le status quo sur les biens de Interhandel jusqu'à la décision finale de cet arbitrage, justifiée par la "Loi des nations":
"The Federal Council is convinced that the Government of the United States of America will, in view of the contemplated arbitration or conciliation proceedings, uphold the principles of the law of nations, whereby good faith demands that all action be avoided during the course of procedure which might prejudice the execution of the decisions of an arbitration court or tzhe acceptance of the proposals of a conciliation commission, and, in addition, that the parties involved refrain from undertaking any kind of action whatsoever which might heighten or increase the difference in question. Therefore, in the sense of these principles of good faith, as laid down in numerous arbitration treaties, in which underlie the authority of the International Court of Justice to take appropriate precautionary measure, the Federal Council requests the government of the United States of America to ensure that the status quo relating to the assets of the Interhandel located in the United States remains unchanged during the course of the arbitration or conciliation proceedings." -> Sur la position du gouvernement américain sur la demande suisse:
"Le Gouvernement des Etats-Unis regrette vivement que le cas Interhandel et l'interprétation des dispositions de l'accord entre la Suisse et les Alliés aient été si longtemps la cause de désaccords entre les Etats-Unis et la Suisse. Les deux gouvernements ont fait connaître, pendant une période de plusieurs années et à maintes occasions, leurs vues à ce sujet. Tenant compte des relations traditionnellement fructueuses et amicales entre les Etats-Unis et la Suisse, le Gouvernement des Etats-Unis a examiné très sérieusement les vues exprimées dans la note susmentionnée [celle du 9.8.1956]. Ceci a nécessité un long réexamen approfondi par le Gouvernement des différentes questions compliquées relatives aux propositions du Gouvernement suisse. Ce réexamen l'a amené à confirmer les vues sur cette question déjà communiquées au Gouvernement suisse à plusieurs occasions depuis 1947.
Le Gouvernement des Etas-Unis regrette par conséquent d'informer le Gouvernement suisse que, pour les raisons mentionnées en détail dans le mémorandum ci-annexé [voir photocopie du résumé du Dépt. Pol. du dit mémorandum], il ne peut pas se déclarer d'accord avec la proposition du Gouvernement suisse tendant à ce que cette affaire soit soumise à arbitrage parce que l'affaire n'implique pas un différend tombant sous l'obligation de recourir à l'arbitrage. Il en est de même pour la proposition de conciliation: le Gouvernement des Etats-Unis regrette de ne pouvoir donner suite à cette proposition pour les raisons mentionnées dans le mémorandum susdit. Eu égard à cette conclusion, le Gouvernement des Etats-Unis regrette également de déclarer qu'il ne peut pas donner son accord à la demande du Gouvernement suisse que le statu quo soit maintenu à l'égard des avoirs d'Interhandel situés aux Etats-Unis.
Le Gouvernement des Etats-Unis rappelle ses notes des 27.5.1953 et 7.6.1955 au Gouvernement suisse, dans lesquelles le Procureur Général des Etats-Unis se déclarait d'accord de négocier avec les parties un règlement du cas devant les tribunaux des Etas-Unis. Le Procureur Général reste disposé à entrer en négociations directes avec les parties au procès ou leurs représentants dûment autorisés, à la lumière de l'état du procès, en vue d'un règlement du cas, qui tiendrait compte des intérêts légitimes de toutes les parties que cela concerne.", (pp. 1-3)
