De l'Article 113 du Traité de Maastricht: "... La Commission, pour la mise en oeuvre de la politique commerciale commune, soumet des propositions au Conseil... qui l'autorise à ouvrir les négociations nécessaires. Ces négociations sont conduites par la Commission en consultation avec un Comité spécial désigné par le Conseil pour l'assister dans cette tâche... " (http://www.tni.org, 19.8.2014).

The 113 Committee originates in the Rome Treaty as a 'special committee, appointed by the Council to assist the Commission' and consult it in international trade negociations. It was established as part of the decision-making apparatus for the common commercial policy, itself a central element of the Rome Treaty.

The third institution referred to in the Rome Treaty is a special committee. Based on the language of Article 113, it seems clear that the Council viewed the special committee as its representative or watchdog over the Commission in its work on trade issues. Initially called the 113 Committee but renamed the 133 Committee, it plays a key role in helping member states influence EU trade policy. (The 133 Committee is still referred to as the 113 Committee in a number of journals and articles. With the entry into force of the Amsterdam Treaty in 1997, the 113 Committee was renamed the 133 Committee as a result of the renumbering of Article 113 of the Treaty of Rome.)
